Unlike great T.V. courtroom drama, in a real NJ personal injury trial, the bad guy does not break-down on the witness stand, and acknowledge his guilt at five minutes to eleven o'clock. There are generally no surprises at trial when two experienced lawyers battle it out for their clients, because both sides learn everything possible about the other side's case during "DISCOVERY" (aptly named).
This is a period of time that commences on the date an answer is filed and served by defense counsel, until the end date of discovery fixed by court rules. During this period of time, attorneys ply their skills by serving interrogatories (written questions), and asking questions face to face with parties, experts, and lay witness involved in the lawsuit. There is a court reporter taking down everything that is said during the deposition; and the witness testifies under oath to tell the truth (depositions).
