Interrogatories

The victim of a N.J. car accident was seriously injured in an automobile accident, and treatment is concluded. The defendant's insurance company made an offer to settle the car accident case, but it was way too low.
What's next?

  • A complaint is filed in Superior Court.
  • Defendant is served with a copy of the complaint
  • Defendant turns the complaint over to her insurance carrier; who will hire a defense attorney to represent her
  • The defense attorney will file an answer with the court, and serve a copy of the answer on plaintiff's lawyer.

Next, "Discovery" begins. A N.J. personal injury attorney has a number of tools in his/her resources in her tool box. The first tool is
Interrogatories.

Interrogatories are a series of written questions posed by the parties to elicit relevant information about the N.J. car accident case.

Why are interrogatories so vital to a successful outcome of a plaintiff's N.J. personal injury case?

For many reasons. Here are just a few:
  • You certify that all the information you provide is the truth. You answers can be used later in discovery or at trial to impeach your credibility with inconsistent statements
  • The value of your case is measured, in part, by the information you provide in your answers.

For example, here is an answer to number 3 that advances the value of your case:

3. Detailed description of the nature, extent and duration of any and all injuries? A sample answer:

I was severely injured in an auto accident. I injured my head, neck and back in this accident. I suffered a cerebral concussion with loss of consciousness; a herniated cervical disc at C4-5, with painful restriction of motion; pain radiates from my neck down to the fingers of my right hand, with numbness; a herniated lumbar disc at L5-S1; my back pain goes down my leg into my foot, with numbness;

I have difficulty in engaging in many of my daily activities such as, walking, sitting, driving in a car, jogging, playing tennis. My constant pain and loss of enjoyment of life makes me depressed.
